You could think of it as they need different standards to 'win'. In this example the 25% was enough to take away the draw.
I know your way of looking at it is correct, but this is also possible.

Percentage has absolutely nothing to deal with this case being a draw, and I thought that you would have understood that by simply looking at the 99% to 1% comparison in my original explanation. He was right, and I was right. Both sides of the discussion were correct (to what extent doesn't matter), therefore it was a draw. This is a specific situation in which I can call it a draw, whereas there are others which I would not call it a draw.
