Its all about initial costs, and no indie developer even on Minecraft scale will fight a legal battle against a corporate giant over a single word.
Also, although the word "Scroll" is not a direct link to "Elder Scrolls", it holds a lot of resemblance and with copyright/trademark laws, you do not have to be exact with your copyright, only have to prove some resemblance...
I am surprised Blizzard didn't sue them for using "Mine-craft"
