Of course, any insurance or major money cases usually last many years.

They are not invincible, it only takes 1 government in the EU to start setting up "no hosting torrent" laws and shit will hit the fan.
Pirating will exist forever, no doubt.

Sorry, by torrent I didn't mean format.

I meant basically copyright does not need to be direct material but illegal to distribute indirect files leading to copyrighted material.
P2P originated and is still widely used legally.

There are already laws regarding providing access to copyright material, which I believe is what our peg-legged swedish friends were done for.
Yes, but the current law doesn't put what they are doing as an offence (hence why they have got around and survived so long). I am talking about making any form of distribution directing someone to another place to obtain these links illegal.

For example, I give you a file (ignoring filetype) and that file gives you some form of acces (via a new p2p idea) would be now illegal for me.

Yes and no.

They do not HOST the illegal material, all material is hosted on individual user computers. the torrent file simply tells the software who to connect to and what to download.

So, by law, they are hosting nothing illegal. If I made a text file of where you can illegally download software online, then that would not be illegal to host that text file, as the file itself contains no copyrighted material, it only directs you.

Its complicated but at the moment, receiving even a small amount of jail time is unbelievably hardcore for this crime, let alone the amount expected. The only thing a fine of that proportion will do to these guys is put them into bankruptcy. Nobody gets paid out but their lives will be harder in future (no monthly contracts, no leasing, nothing). Company likes Disney and Warner brother are losing out on an amazing amount of money (in theory) due to piracy but you have to consider these impossible to measure 'facts':
- People download with intention of future purchase.
- Some people download because they don't have money to purchase
- Some people are not that bothered for what they download, but a freeby is free.

The losses are a lot less than they make out, most people who download would've never bought the downloaded material if piracy didn't exist.

There may be a site with more dedicated subjects, but you do not get a "biggest in the world" sticker if it isn't true.

depends on what you mean by "more dedicated subjects". The site which I was talking about has nearly the same ammount of p2p files which you would find on TPB, but the download rate of most of the files is around the max download rate for me (which is 200 kb/s and I have no idea why I have never downloaded a file faster than that besides that my internet sux balls) and I know a few people get up to 1.5 mb/s from it.
